Terms of Service

1. Acceptance

By creating an account or using the Petit Lunch platform at app.petitlunch.com, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms form a legally binding agreement between you and Petit Lunch Inc. ("Petit Lunch", "we", "our"), a company incorporated in Canada.

2. The Service

Petit Lunch is an online platform that allows parents and guardians to order school lunches from approved food vendors for their children attending participating Canadian schools. We act as a marketplace; individual food vendors are responsible for preparing and delivering the meals.

3. Eligibility

  • You must be at least 18 years old to create an account.
  • You must be a parent or legal guardian of the child(ren) for whom you are ordering.
  • Your child's school must be enrolled in the Petit Lunch platform.

4. Orders and Payment

Order cut-off

Orders must be placed before the cut-off time set by your school (typically 6:00 PM the evening before the meal date). Late orders cannot be accepted.

GST/HST exemption

School meal orders are zero-rated under the Excise Tax Act of Canada, Schedule V, Part III, section 14. No GST/HST is charged on qualifying meal orders.

Payment processing

Payments are processed by Stripe, Inc. By placing an order, you authorize Petit Lunch to charge your saved payment method for the order total.

Pricing

Meal prices are set by the vendor and displayed at checkout. Prices may change between order cycles; you will always see the current price before confirming.

Subsidies

If your child's school board has assigned a subsidy to your account, the subsidy amount will be automatically deducted at checkout. Subsidy balances are managed by the school.

5. Cancellations and Refunds

  • Orders cancelled before the cut-off time will be fully refunded to your original payment method within 5–10 business days.
  • Orders cancelled after the cut-off time are not eligible for refund unless the vendor is unable to fulfil the order.
  • If a meal is not delivered due to vendor error, contact us at contact@petitlunch.com within 48 hours for a full refund.
  • Refunds for allergic reactions or food safety incidents are handled on a case-by-case basis.

6. Allergy and Health Information

You are responsible for keeping your child's allergy and health profile accurate and up to date. Petit Lunch and participating vendors use this information to flag potential allergens, but we cannot guarantee a completely allergen-free environment. If your child has a severe or life-threatening allergy, please contact the school and vendor directly before ordering.

Important safety notice

Petit Lunch's allergen flagging is an aid — not a guarantee. Cross-contamination can occur in any food preparation environment. Always verify directly with the vendor for severe allergies.

7. Acceptable Use

You agree not to:

  • Use the platform for any purpose other than ordering school meals for your children
  • Provide false or misleading information, including false allergy or health data
  • Attempt to access another user's account or data
  • Interfere with platform security or performance

8. Limitation of Liability

To the maximum extent permitted by Canadian law, Petit Lunch's total liability for any claim arising from use of the platform is limited to the amount you paid for the order giving rise to the claim. We are not liable for acts or omissions of vendors, schools, or school boards.

9. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Ontario.

10. Changes to These Terms

We will notify registered users by email at least 14 days before any material change to these terms. Continued use of the platform after that date constitutes acceptance of the revised terms.
